The conservative case against the FMA.

Thanks to Mr. Hanna for sending me this link regarding the conservative argument against the Federal Marriage Amendment.

When will conservatives concede that the proper view of federalism has not existed since Stephen Sutherland's brilliant defense of it was overturned in West Coast Hotel v. Parrish? And that virtually all constitutional jurisprudence since has been in the direction of nationalization of all constitutionalism?

That doesn't make it right, but it has been happening.

Yes, we can sit around and be great constitutional intellectuals and cling to our proper view of the Constitution. Gawd knows I do my share of that. But policy victories are not always (perhaps even rarely) won that way. I refuse to condemn some conservatives for recognizing reality and fighting the war on the ground also.

Might as well be loser libertarians if we're just going to sit around and bitch all the time that nobody accepts our wacky intellectual theories (even the ones that happen to be right).

True. But the other extreme is to care only about winning without regard to wacky things like principles. Might as well be Democrats if we ONLY care whether we win every fight. Sometimes the losing battle is still the right one in the long run (think Barry Goldwater).
